Open Records Policy

OPEN RECORDS OFFICER

Centerville Borough hereby designates the appointed Borough Secretary/Treasurer, Cheryl A. Matesich, as the Open Records Officer.

REQUESTS

All documents deemed public records shall be available for inspection, retrieval, and duplication at the Centerville Borough Municipal Building by contacting the Open Records Officer during established business hours from 7:30 a.m. to 3:30 p.m., Monday through Friday, excluding holidays.

Requests shall be in writing on a form provided by the Borough and shall include the date of the request, the name and address of the requester and a clear description of records sought. All requests shall be directed to the Open Records Officer, Centerville Borough Municipal Building, 100 East End Road, Brownsville, PA 15417; telephone 724-785-9206; facsimile 724-785-9208; or email office@centervilleboro.org.

FEES

Paper copies will be $0.25 per page per side. If mailing is requested, the cost of postage will be charged. Fax copies will be available at $0.50 per page. The certification of a record will be $2.00 per record. Specialized documents including, but not limited to blue prints, color copies, and non-standard sized documents shall be charged the actual cost of production. The Borough will require prepayment if the total fees are estimated to exceed $100.00.

RESPONSE

The Open Records Officer will make a good faith effort to provide the requested public records as promptly as feasible. The Open Records Officer shall cooperate with those requesting records to review and/or duplicate original Borough documents while taking reasonable measures to protect Borough documents from the possibility of theft, damage, and/or modification.

The Open Records Officer shall review all written requests for access to public records. As soon as possible, but no later than five (5) business days after receiving a written request to access public records, the Open Records Officer shall respond to all such requests in writing in a manner consistent with Act 3 of 2008, the Pennsylvania Right-to- Know Law. If access to a Borough record is denied, the response shall include a reason for denial as stipulated in Act 3 of 2008.

APPEAL PROCESS

If a written request is denied or deemed denied, the requester may file an appeal with the Pennsylvania Office of Open Records.
The appeal must be submitted to the Office of Open Records within 15 business days of the mailing date of the Agency’s response. Appeals should be sent to the Office of Open Records, Commonwealth Keystone Building, 400 North St., 4th Floor, Harrisburg, PA 17120-0225. They may also be submitted via facsimile to 717-425-5343 or via email to openrecords@state.pa.us as a Microsoft Word or PDF attachment.
The appeal shall state grounds on which the requester asserts that the record is a public record and shall address any grounds stated by the Borough for denying the request.
